All products are quality checked and shipped with the utmost care.

Cancellation / Returns - “NCNR”: All sales are FINAL. By purchasing from RocketDisk, Customer agrees to purchase the Product, pay the purchase price and comply with all other terms and condition. This transaction is “NCNR”, meaning non-cancelable and non-returnable. This Agreement and order cannot be cancelled by Customer. The Product ordered/purchased cannot be returned. Customer understands and agrees that it assumes full liability for any product that (i) has been shipped to it, (ii) is being held in inventory by RocketDisk for Customer, (iii) has been ordered from and manufactured by RocketDisk’s supplier(s), (iv) is a work-in-process or pre-built by RocketDisk’s supplier(s), or (v) parts that, in conjunction with the manufacturer, cannot be moved out to a newly requested date. RocketDisk may accept credit card payments from Customer. By purchasing from RocketDisk, Customer hereby authorizes RocketDisk to charge the credit card provided by Customer for the full amount of the purchase price and any other payment obligations created by this Agreement. Customer acknowledges that all sales are final and that all payments made by credit card or otherwise are non refundable. Accordingly, Customer may not dispute credit card charges once made or seek/obtain chargebacks.

Non-Conformity: Customer shall inspect all Products at the time of delivery. Customer shall notify RocketDisk no later than 48 hours from the time of delivery if any non-conforming Product was received. Failure to provide timely written notice shall constitute an acceptance by Customer of the shipped Product and a waiver of all non-conforming and Agreement remedies. Within a reasonable time of receiving such notice, Rocketdisk may request further information and/or provide Customer with instructions regarding the disposition of the non-conforming units. Customer understands that Products are subject to manufacturer warranty and that the only basis for a claim of non-conforming goods shall be the receipt of the wrong product or an inaccurate number of units shipped.

Delivery: Delivery of Product shall be arranged by RocketDisk and paid for by Customer.  Product purchase prices do not include shipping/delivery charges. Unless otherwise agreed in writing, all shipments are FOB origin, freight pre-paid and added, from RocketDisk’s principal place of business, or other location designated by it, to Customer’s pre-approved address. Any expressions regarding delivery date, whether oral or written, are estimates only. Although RocketDisk will expend its best effort to meet any estimated delivery date, Customer understands that unforeseen circumstances may result in delay and Customer agrees to hold RocketDisk harmless of any and all damages sustained as result thereof. Any delivery charges set forth in this Agreement are based on single occurrence. If Customer is not present for any scheduled delivery, re-delivery fees may apply. RocketDisk.com charges a shipping rate for the initial product delivery to our customers. Shipping and handling on defective merchandise shall be the responsibility of the customer and shall not the responsibility of RocketDisk. Any RocketDisk.com products damaged during shipment are the responsibility of the shipping carrier and not the responsibility of RocketDisk.com. It is the responsibility of the customer to inspect all merchandise at the time of delivery for damage. Any and all claims due to damage during shipping shall be made to the shipping carrier at the time of delivery and not to RocketDisk.com. RocketDisk.com shall be held harmless for any damages incurred during shipping.

Warranty/Disclaimer: Customer acknowledges that RocketDisk is NOT the manufacturer of the Product being purchased. Customer’s warranty rights and claims, if any, shall exist solely with the manufacturer of the Product. By purchasing from RocketDisk, Customer acknowledges that it has, or was given the opportunity to conduct due diligence regarding the Product, including its specifications and fit for Customer’s intended use. Customer acknowledges that, notwithstanding any discussion regarding the Product, Customer has not relied on any statements made by RocketSDisk, including any that the Product will satisfy Customer’s intended use. Except for the terms and conditions in this Agreement, RocketDisk does NOT make any representations with respect to the Product, which is sold by RocketDisk as-is and without any warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose. No agent, employee or other representative of RocketDisk has the authority to bind RocketDisk to any promise or term that is not expressly provided for herein.   RocketDisk cannot and does not make any representations with respect to manufacturer policies and processing of warranty claims, or any other conduct by manufacturer.  Nothing in this warranty disclaimer is intended to affect the availability of any Manufacturer warranty applicable to Customer and the Product purchased. All RocketDisk.com customers shall have the responsibility to ensure that each and every product they purchase from RocketDisk.com is suitable and appropriate for their intended purpose.

Customer Purchase Orders: Customer may issue and present a purchase order(s) for purposes of its own administrative use. RocketDisk’s receipt of any purchase order, before or after Customer signs this Agreement, or any other conduct by RocketDisk after presentment of a purchase order by Customer, shall NOT constitute an acceptance of any of the terms and conditions stated therein. It is expressly understood and agreed that the terms and conditions of this Agreement alone shall be controlling and bind the parties with respect to all matters concerning the sale/purchase of the Product.

Miscellaneous: RocketDisk, Inc. is a California corporation (referred to herein as “RocketDisk”). Customer agrees that any and all promises in this Agreement to indemnify and hold RocketDisk harmless shall also include and inure to the benefit of RocketDisk’s shareholders, officers, directors, employees and agents. The rights and obligations of the parties relating to this Agreement shall be governed by the laws of the State of California, U.S.A. Customer consents to jurisdiction in the State of California and to proper venue in the City of Beverly Hills, California. This Agreement constitutes the entire agreement of the parties. No representation, statement, term or condition not contained in this Agreement will be binding. Each term of this Agreement is severable and, although it is the intent of the parties that each term be enforced to the fullest extent, if any term is deemed invalid or unenforceable by a court of competent jurisdiction, the remainder of this Agreement will continue in full force and effect. In the event RocketDisk is compelled to enforce the terms of this Agreement, including the collection of money due, it shall be entitled to all attorneys fees, collection costs and other charges incurred as a result.

CUSTOMER ASSUMES ALL RISK OF LOSS RESULTING FROM ITS USE OF THE PRODUCT PURCHASED AND FURTHER AGREES TO INDEMNIFY AND HOLD ROCKETDISK HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES AND/OR DAMAGES SUSTAINED IN CONNECTION WITH CUSTOMER’S PURCHASE AND/OR USE OF THE PRODUCT. UNDER ANY CIRCUMSTANCES, IT IS EXPRESSLY UNDERSTOOD AND AGREED THAT ROCKETDISK SHALL NEVER, IN ANY EVENT, BE LIABLE TO CUSTOMER FOR ANY SUM EXCEEDING THE PURCHASE PRICE OF THE PRODUCT. For purposes of this limitation on liability, Customer shall be deemed to include Customer and any other end user of the Product.
